Terms
The rules off the board.
The rules of the game are in the app. This page says what applies between you and us: the account, the full version, how we treat each other, and what we do and do not promise.
Version 1, valid from [date of publication].
This is a translation. If it differs from the Dutch version, the Dutch version is the leading one.
1. Who we are
Borderline Case is a game by [company name], [address], Dutch Chamber of Commerce (KvK) [KvK number], VAT [VAT number]. Contact: stedenstrijd@bitma.nl.
These terms apply to the app Borderline Case and everything that comes with it, such as the invitation pages on this website. By using the app, you agree to them.
2. Your account
- On first launch you get an anonymous account. If you link it with Apple, you can find it again on another device.
- You are 13 or older. If you are under 16, you play with the consent of a parent or guardian, who also makes the purchase.
- One account per person. Several accounts to get round the limits of the free version are not allowed.
- You can delete your account at any time, in the app, under Me, at Account. What happens then is in the privacy statement.
3. Free and the full version
For free you play everything, within the limits stated in the app: with Quick play the server picks your city, in a round past all cities; one running game; joining as a guest up to a number of times per week; and practice in one city at the first level. The full version opens all cities, all levels and all ways of playing, and lets you start games yourself.
- One-off. The full version is a one-off purchase, not a subscription. The price is the one in the App Store at the moment you buy.
- Through Apple. You pay Apple, under the terms of the App Store. We do not see your payment details.
- New cities. Cities we add later are part of the full version at no extra charge. We do not promise how many cities will come or when.
- Family Sharing. The full version also works for your family through Apple's Family Sharing.
- Restoring. On a new device or a new account you tap Restore purchase. The purchase belongs to your Apple ID.
- Refunds. You request a refund from Apple, via reportaproblem.apple.com. Apple decides on it. If you get your money back, the full version lapses.
The full version is digital content that you receive immediately after the purchase. You agree that delivery starts at once, and with that the statutory right of withdrawal lapses. This does not affect Apple's refund policy.
4. At the table
Borderline Case is a game about neighbourhood rivalry. On the board you may be hard. Off it, not.
- Your name is not insulting, discriminatory, sexual or misleading, and does not pass you off as someone else, including us.
- A photo of your own shows only what you are allowed to show: no nudity, violence, hate or someone else without permission.
- You play the game as it is meant to be played. No bots or scripts, no exploiting bugs, no attacking or scraping the app or the server, and no arranging with others to rig a game or the leaderboard.
- You can block and report anyone who harasses you. We look into every report.
If you do not keep to this, we can remove your name or photo, temporarily exclude you from public games, correct your place on the leaderboard, or terminate your account. We choose what fits what happened. If we terminate your account for that reason, you are not entitled to a refund of the purchase, as far as the law allows.
5. The game itself
- The server decides. Dice, moves and the clock run on our server. What the server records is the outcome of the game.
- Time is time. If your turn runs out, the server finishes your turn. If you miss three turns in a row, an AI player takes over your seat. Giving up counts as a loss.
- We improve the game. We change rules, cities, AI players and the leaderboard when that makes the game better or fairer. A game that is already running is played out under the rules it started with.
- Leaderboard and titles give no right to anything, and we may correct them if something went wrong or if there was cheating.
6. What belongs to whom
- The app, the design, the texts and the name Borderline Case are ours. You get a personal right to use the app for as long as these terms apply. Copying it, reselling it or making your own version of it is not allowed.
- The maps are made with open data from CBS and Kadaster (PDOK), under CC BY 4.0. The characters are Open Peeps by Pablo Stanley (CC0), via DiceBear.
- Buildings and places in the game, such as the landmarks, carry their real name because they stand in that city. Their owners are not involved in Borderline Case and do not endorse the game.
- A photo you upload remains yours. You give us the right to show it in the game for as long as it is there.
7. Availability
We do our best to keep Borderline Case playable at all times, but an online game can have outages, and sometimes we have to do maintenance. That is not a failure on our part, unless it is caused by our gross negligence.
8. Stopping
A game does not exist for ever. If we stop Borderline Case or its online parts, we announce that in the app at least 90 days in advance. In that time you can finish your games and download your data. If we stop within 12 months after you bought the full version, then [decision: what we do then, for example refund the purchase price pro rata].
9. Liability
Borderline Case is a game. We are liable for damage from its use only if it is caused by our intent or gross negligence, and then up to at most the amount you paid for the full version. This does not apply where the law prescribes a different rule that you as a consumer cannot waive.
10. Apple
You got the app from the App Store. Alongside these terms, Apple's standard licence agreement for apps applies (Licensed Application End User License Agreement). If they differ, these terms take precedence, except where Apple's rules require otherwise. Apple is not a party to these terms and is not responsible for the app, its support or its maintenance. We are.
11. Changes
We can change these terms, for example if the game changes or the law does. We announce a material change in the app at least 30 days in advance. If you keep playing after that, the new terms apply. If you do not want that, you can delete your account.
12. Questions and disputes
If you have a complaint, email us at stedenstrijd@bitma.nl. We respond within 14 days. If we cannot work it out together, you can go to court. Dutch law applies to these terms. As a consumer you may also go to the court where you live, and you keep the protection that the law of your own country gives you.
