Deze voorwaarden gelden voor het gebruik van de app en webversie van Tric Trac 420 Edition ("de app"), aangeboden door bitma (Nederland). Door de app te gebruiken ga je akkoord met deze voorwaarden. Ga je niet akkoord, gebruik de app dan niet.

1. De app

De app is een digitale versie van het bordspel Trictrac (backgammon-variant), met onlinepotjes tegen vrienden, ranglijsten en optionele AI-tegenstanders. Het cannabis-/coffeeshopthema is uitsluitend humoristisch: de app bevat geen drugs, verkoopt niets dergelijks en moedigt geen gebruik aan.

2. Leeftijd

De app is bedoeld voor gebruikers van 18 jaar en ouder. Door de app te gebruiken verklaar je 18 jaar of ouder te zijn.

3. Account

  • Voor onlinefuncties heb je een account nodig (inloggen via Google of e-mail).
  • Je bent verantwoordelijk voor je account en kiest een bijnaam en avatar die niet kwetsend, misleidend of inbreukmakend zijn.
  • Je mag geen accounts van anderen gebruiken of je als iemand anders voordoen.
  • Account verwijderen kan via trictrac@bitma.nl (zie ook het privacybeleid).

4. Eerlijk spel & gedrag

Het is niet toegestaan om:

  • vals te spelen, spelresultaten of ranglijsten te manipuleren, of bugs/exploits te misbruiken;
  • de app te reverse-engineeren, geautomatiseerd te bespelen (bots) of de servers te overbelasten;
  • in de chat haatdragende, discriminerende, bedreigende of anderszins ongepaste inhoud te plaatsen;
  • de AI-chat te misbruiken om schadelijke of ongepaste inhoud uit te lokken.

Bij overtreding kunnen we waarschuwen, resultaten corrigeren of je account (tijdelijk) blokkeren of verwijderen.

5. VIP-abonnement (in-app-aankopen)

  • "Coffeeshop VIP" is een optioneel abonnement met extra's zoals AI-tegenstanders en cosmetics. Prijzen en looptijden (maand, kwartaal, jaar) staan in de app en in de App Store / Google Play.
  • Betaling, verlenging en opzegging verlopen volledig via je Apple- of Google-account. Het abonnement verlengt automatisch, tenzij je het minimaal 24 uur voor het einde van de periode opzegt via de abonnementsinstellingen van je store-account.
  • Eerdere aankopen herstel je met "Herstel aankoop" in de app.
  • Restitutie verloopt via Apple/Google volgens hun voorwaarden.

6. AI-inhoud

AI-personages genereren hun chatberichten automatisch. Wij doen ons best deze passend te houden, maar AI-uitvoer kan onverwacht of onjuist zijn en vertegenwoordigt niet onze mening. AI-berichten zijn vermaak, geen advies.

7. Intellectueel eigendom

De app, het ontwerp, de graphics, namen en personages zijn eigendom van bitma of diens licentiegevers. Je krijgt een persoonlijke, niet-overdraagbare, niet-exclusieve licentie om de app voor eigen gebruik te gebruiken. Verder kopiëren, verspreiden of commercieel exploiteren is niet toegestaan.

8. Beschikbaarheid & wijzigingen

We mogen de app, functies, ranglijsten en seizoenen op elk moment wijzigen, pauzeren of beëindigen. We streven naar goede beschikbaarheid maar garanderen geen ononderbroken werking. Voortgang (zoals ELO, badges en cosmetics) heeft geen geldwaarde en kan bij beëindiging van de dienst vervallen.

9. Aansprakelijkheid

De app wordt geleverd "zoals hij is". Voor zover wettelijk toegestaan zijn wij niet aansprakelijk voor indirecte schade of verlies van speldata/voortgang. Niets in deze voorwaarden beperkt aansprakelijkheid die naar Nederlands recht niet beperkt kan worden, of je wettelijke rechten als consument.

10. Toepasselijk recht

Op deze voorwaarden is Nederlands recht van toepassing. Geschillen worden voorgelegd aan de bevoegde rechter in Nederland, onverminderd dwingende consumentenbescherming.

11. Wijzigingen van deze voorwaarden

We kunnen deze voorwaarden wijzigen. Bij belangrijke wijzigingen passen we de datum bovenaan aan en informeren we je waar nodig in de app. Blijf je de app gebruiken na een wijziging, dan geldt de nieuwe versie.

These terms apply to the use of the app and web version of Tric Trac 420 Edition ("the app"), offered by bitma (the Netherlands). By using the app you agree to these terms. If you do not agree, do not use the app.

1. The app

The app is a digital version of the board game Trictrac (a backgammon variant), with online games against friends, leaderboards and optional AI opponents. The cannabis/coffeeshop theme is purely humorous: the app contains no drugs, sells nothing of the kind and does not encourage use.

2. Age

The app is intended for users aged 18 and over. By using the app you declare that you are 18 or older.

3. Account

  • Online features require an account (sign in via Google or email).
  • You are responsible for your account and must choose a nickname and avatar that are not offensive, misleading or infringing.
  • You may not use other people's accounts or impersonate anyone else.
  • You can delete your account via trictrac@bitma.nl (see also the privacy policy).

4. Fair play & conduct

You are not allowed to:

  • cheat, manipulate game results or leaderboards, or abuse bugs/exploits;
  • reverse-engineer the app, play it in an automated way (bots) or overload the servers;
  • post hateful, discriminatory, threatening or otherwise inappropriate content in the chat;
  • misuse the AI chat to elicit harmful or inappropriate content.

In case of violations we may issue warnings, correct results, or (temporarily) block or delete your account.

5. VIP subscription (in-app purchases)

  • "Coffeeshop VIP" is an optional subscription with extras such as AI opponents and cosmetics. Prices and durations (month, quarter, year) are listed in the app and in the App Store / Google Play.
  • Payment, renewal and cancellation are handled entirely through your Apple or Google account. The subscription renews automatically unless you cancel it at least 24 hours before the end of the period via the subscription settings of your store account.
  • You can restore previous purchases using "Restore purchase" in the app.
  • Refunds are handled by Apple/Google according to their terms.

6. AI content

AI characters generate their chat messages automatically. We do our best to keep these appropriate, but AI output can be unexpected or incorrect and does not represent our opinion. AI messages are entertainment, not advice.

7. Intellectual property

The app, its design, graphics, names and characters are the property of bitma or its licensors. You are granted a personal, non-transferable, non-exclusive licence to use the app for your own use. Any further copying, distribution or commercial exploitation is not permitted.

8. Availability & changes

We may change, pause or discontinue the app, its features, leaderboards and seasons at any time. We aim for good availability but do not guarantee uninterrupted operation. Progress (such as ELO, badges and cosmetics) has no monetary value and may lapse if the service is discontinued.

9. Liability

The app is provided "as is". To the extent permitted by law, we are not liable for indirect damage or loss of game data/progress. Nothing in these terms limits liability that cannot be limited under Dutch law, or your statutory rights as a consumer.

10. Governing law

These terms are governed by Dutch law. Disputes will be submitted to the competent court in the Netherlands, without prejudice to mandatory consumer protection.

11. Changes to these terms

We may change these terms. In the event of significant changes, we will update the date at the top and, where necessary, inform you in the app. If you continue to use the app after a change, the new version applies.
